Terms Of Use and Liability Agreement
These Terms apply to all services provided by David D’Amore, trading as Dave Drums (“we,” “us,” or “our”), including those delivered by our team, contractors, or authorised representatives. Services include:
Lessons: In-person and online sessions – including individual, group, workshops, and scheduled events.
Learning Platforms: Subscriptions, courses, and educational content via davedrums.com.au, Soundslice, or other platforms.
Website Use: Access to davedrums.com.au and all included materials.

By using our services, you agree to these Terms and confirm that you’ve read and understood them. If the student is under 18, a parent or guardian must agree on their behalf. We’ll notify you of any updates via email, and continued use means you accept any changes. You can review the current version anytime at: www.davedrums.com.au/terms

1.1 Assumption of Risks
Participation may involve risks (e.g, injury or property damage), which you accept voluntarily.
1.2 Release and Discharge
We are not liable for injuries or damages incurred during lessons, events, or equipment use, including those caused by representatives acting on our behalf.
1.3 Indemnification
You agree to indemnify us and our representatives against claims related to participation.
1.4 Medical Emergencies
We may arrange medical assistance in emergencies, at your cost.
1.5 Media Use
You grant us permission to use photos, videos, or recordings taken during lessons or events for promotional purposes.
Media will not be captured during school programs unless prior approval is granted by the school.

2.1 Bookings and Payments
Lessons are paid in advance through online booking.
Cash payments may be arranged upon request.
2.2 Brinsmead Studio Lessons
5- and 10-Lesson Packs reserve a regular weekly time for either 5 or 10 consecutive weeks.
10-Lesson Packs include one reschedule with 24+ hours’ notice.
5 Lesson Packs do not include reschedules.
Lesson Packs cannot be cancelled or refunded once bookings are confirmed and started.
Small Group Lessons need at least 2 students to run at full length. If only one attends, the session will be shortened or offered as a private lesson with an adjustment fee.
2.3 In-School Programs
Term enrolments are prepaid and follow the school timetable.
One lesson per term may be rescheduled for a school event (excursions, carnivals, exams etc) or illness, with 24+ hours’ notice.
Make-up lessons take place at the end of term.
Duo Lessons require 2 students. If only one attends, the session becomes a private lesson with an adjustment fee.
2.4 Cancellations, Teacher Absence and Refunds
Lessons can be rescheduled with at least 24 hours’ notice. All requests must be sent via email.
If a teacher is unavailable, a make-up lesson or future credit will be arranged.
Missed lessons or late cancellations (less than 24 hours) are charged in full.
No refunds are available for missed, completed, or expired lessons.
2.5 Student Expectations
Students are responsible for bringing their own drumsticks to each lesson.
Respect for teachers, fellow students, and equipment is expected at all times.
Students who are disruptive may be removed from the session. Any damage caused will be charged to the student or guardian.

3.1 Subscription
Billed monthly and renews automatically until cancelled.
Payments are final and non-refundable. In the case of prolonged technical issues, may be offered at our discretion.
3.2 Suspensions and Cancellations
Subscriptions cannot be paused. To cancel, submit a request via email or the website contact page at www.davedrums.com.au/contact.
Access to your learning materials ends immediately upon cancellation.
3.3 Content Use
All materials are protected by copyright and are intended for individual, personal use only. Reproduction, distribution, or commercial use without prior written consent is prohibited.

4.1 No Guarantees
Our services are provided 'as is' with no guaranteed outcomes, as progress depends on individual effort and other factors.
4.2 Force Majeure
We are not liable for delays or disruptions caused by events beyond our control (e.g., natural disasters, government actions, or technical failures).
4.3 Disputes
These Terms are governed by the laws of Queensland, Australia. Disputes unresolved through discussion will proceed to mediation or court within Queensland’s jurisdiction.
4.4 Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full effect.
4.5 Termination
We reserve the right to terminate access to services due to breaches of these Terms, including non-payment or inappropriate conduct.
4.6 Privacy
We respect your privacy. Personal information collected during bookings or subscriptions is used only for communication and account access. We do not share your details with third parties.
