Terms Of Use & Liability Agreement
These Terms apply to all services provided by David D’Amore (trading as Dave Drums), including those delivered by our team, contractors, or authorised representatives. Services include in-person and online lessons, workshops, events, learning platforms, and use of our website.
By using our services, you agree to these Terms. If you are under 18, a parent or guardian must agree on your behalf. You can review the Terms anytime at: www.davedrums.com.au/terms

1.1 Risks
Participation in lessons or related activities involves physical movement and carries some risk (e.g. injury or property damage), which you accept voluntarily.
1.2 Liability
We are not responsible for injury, damage, or loss arising from participation, including actions by our representatives or use of equipment.
1.3 Indemnity
You agree to indemnify us and our representatives against any claims or expenses resulting from participation.
1.4 Emergencies
In a medical emergency, we may seek assistance on your behalf at your expense.
1.5 Media
You grant permission for us to take photos or videos during lessons or events, which may be used for promotional purposes.

2.1 Bookings, Payment & Packs
All lessons are prepaid through online booking. Cash payments may be arranged upon request.
5- and 10-Lesson Packs secure a weekly time slot for consecutive weeks.
10-Lesson Packs include one reschedule with 24+ hours’ notice. 5-Lesson Packs do not include reschedules.
Lesson Packs are non-refundable once your spot is confirmed. If something unexpected comes up, partial refunds may be offered at our discretion.
2.2 Group Lessons
Semi-private group lessons require 3 students to run at full length.
If fewer than 3 students are booked, the session is shortened (45 mins for two students, 36 mins for one), or may continue at full length with an optional adjustment fee ($15 for two, $30 for one).
Adjustment fees must be confirmed in advance.
2.3 Cancellations & Teacher Absence
Lessons may be rescheduled with at least 24 hours’ notice (email only).
If the teacher is unavailable, a make-up lesson will be arranged.
Missed or late-cancelled lessons (less than 24 hours notice) are charged in full.
Missed, completed, or expired lessons are not eligible for refund.
2.4 Student Expectations
Students must treat teachers, students and equipment with respect.
Disruptive behaviour may result in removal from the lesson, and any damage will be charged to the student or guardian.

3.1 Subscription
Access is billed at $15/month and renews automatically until cancelled. The first month is included in the Intro Pack.
Payments are final and non-refundable.
Refunds may be offered for extended technical issues that prevent access to the platform.
3.2 Cancellations
Subscriptions can’t be paused. To cancel, contact us via email or www.davedrums.com.au/contact.
Access ends immediately once cancellation is processed.
3.3 Content Use
All materials are for personal use only and protected by copyright.
Reproduction or sharing is not allowed without permission.

4.1 Expectations & Limitations
Progress depends on individual effort and practice; results cannot be guaranteed.
We may suspend or cancel services for non-payment, inappropriate behaviour, or breaches of these terms.
4.2 Force Majeure
We’re not liable for delays or disruptions caused by events beyond our control (e.g. natural disasters, government actions, or technical issues).
4.3 Disputes
These Terms are governed by the laws of Queensland, Australia. Unresolved matters may proceed to mediation or court within Queensland’s jurisdiction.
If any part of these terms is found invalid, the rest will still apply.
4.4 Privacy
Your personal information is only used for communication and account management. We don’t share your details with third parties.
Important updates or changes will be sent via email or SMS. It’s your responsibility to keep contact details up to date.
