Terms Of Use and Liability Agreement

These Terms apply to all services provided by David D’Amore (trading as Dave Drums), including those delivered by our team, contractors, or authorised representatives.
Services include in-person and online lessons, workshops, events, learning platforms, and use of our website.

  • 1.1 Risks

    • Participation in lessons or related activities involves physical movement and carries some risk (e.g, injury or property damage), which you accept voluntarily.

    1.2 Liability

    • We are not responsible for injury, damage, or loss arising from participation, including actions by our representatives or use of equipment.

    1.3 Indemnity

    • You agree to indemnify us and our representatives against any claims or expenses arising from participation.

    1.4 Emergencies

    • In a medical emergency, we may seek medical assistance on your behalf at your cost.

    1.5 Media

    • You grant permission for us to take photos or videos during lessons or events, which may be used for promotional purposes.

  • 2.1 Bookings & Payment

    • All lessons are prepaid through online booking.

    • Cash payments may be arranged upon request.

    2.2 Lesson Packs

    • 5- and 10-Lesson Packs secure a weekly time slot for consecutive weeks.

    • 10-Lesson Packs include one reschedule with 24+ hours’ notice.

    • 5-Lesson Packs do not include reschedules.

    • Lesson Packs are non-refundable once booked. In special circumstances, partial refunds may be offered at our discretion.

    • Small Group Lessons require at least 2 students to run at full length. If only one attends, the session will be shortened or offered as a private lesson with an adjustment fee.

    2.3 Cancellations & Teacher Absence

    • Lessons may be rescheduled with at least 24 hours’ notice (email only).

    • If the teacher is unavailable, a make-up lesson or credit will be arranged.

    • Missed or late-cancelled lessons (less than 24 hours notice) are charged in full.

    • No refunds are available for missed, completed, or expired lessons.

    2.4 Student Expectations

    • Students must treat teachers, students and equipment with respect.

    • Disruptive behaviour may result in removal from the lesson, and any damage will be charged to the student or guardian.

  • 3.1 Subscription

    • Billed monthly and renews automatically until cancelled.

    • Payments are final and non-refundable.

    • In the case of extended technical issues, a refund may be offered at our discretion.

    3.2 Cancellations

    • Subscriptions cannot be paused. To cancel, contact us via email or the contact page at www.davedrums.com.au/contact.

    • Access to learning materials ends immediately once cancellation is processed.

    3.3 Content Use

    • All materials are protected by copyright and are for personal use only. Reproduction, distribution, or commercial use without prior written consent is prohibited.

  • 4.1 No Guarantees

    • Progress depends on individual effort and practice; outcomes cannot be guaranteed.

    4.2 Force Majeure

    • We are not liable for delays or disruptions caused by events beyond our control (e.g., natural disasters, government actions, or technical issues).

    4.3 Disputes

    • These Terms are governed by the laws of Queensland, Australia. Unresolved matters may proceed to mediation or court within Queensland’s jurisdiction.

    4.4 Severability

    • If any part of these Terms is found invalid, the remaining sections remain enforceable.

    4.5 Termination

    • We may suspend or cancel services due to non-payment, inappropriate behaviour, or breaches of these Terms.

    4.6 Privacy

    • Your personal information is only used for communication and account management. We don’t share your details with third parties.

    • Important updates or changes will be sent via email or SMS. It’s your responsibility to keep contact details up to date.
